1. OUR ROLE AS A LEAD GENERATOR
National Injury Counsel (“we,” “us,” or “our”) is a paid lead generator and marketing provider. We are not a law firm, we do not provide legal advice, and we are not a State Bar-certified lawyer referral service. We collect information from consumers and, for a fee, transfer that information to independent third-party law firms and marketing fulfillment partners (collectively, “Network Partners”) to facilitate a connection between you and a legal professional.
2. INFORMATION WE COLLECT
Identifiers: Name, phone number, email address, and IP address.
Case Specifics: Information regarding your potential injury, date of incident, and medical history.
Sensory Data: Audio recordings and transcripts generated during AI-powered voice interactions. We use Artificial Intelligence (AI) to conduct intake interviews and evaluate claim eligibility.
3. SEPARATE CONSENT FOR COMMUNICATIONS
In compliance with federal regulations and mobile carrier standards, we collect consent separately for different communication channels:
- Voice & AI Calls: By opting in to voice communications, you authorize us and our Network Partners to contact you via live agent, AI-generated voice, and prerecorded messages.
- SMS/MMS Messaging: By opting in to text communications, you authorize us to send automated marketing and informational text messages. Your SMS consent is not shared with unrelated third parties for their own marketing purposes.
4. DATA SHARING & PURPOSE
We share your information only with the intention of helping you find a lawyer. This includes sharing data with:
- Law Firm Partners: For the purpose of evaluating your potential claim for representation.
- Marketing & Fulfillment Partners: Specialized entities that assist us in routing your inquiry, verifying your details, or making initial contact on our behalf.
5. DATA RETENTION: TWO-YEAR POLICY
To fulfill our referral obligations and satisfy TCPA record-keeping requirements, we retain your personal data for a period of two (2) years from the date of collection. After this period, your data is permanently deleted or anonymized unless a longer retention period is required by a specific legal hold or statutory obligation.
6. JURISDICTIONAL EXCLUSION (CALIFORNIA)
National Injury Counsel does not offer services in the State of California. This website and our services are not intended for residents of California or for incidents occurring within California. We do not knowingly collect or process data from California residents. If we determine a lead originated from California, it will be immediately purged from our systems.
